The client was charged with Driving While Intoxicated (registering a .24 BAC) and Reckless Endangerment for almost hitting a police officer. James Pascarella presented a justification defense, touted by many experts as “brilliant.” During the trial, Mr. Pascarella established that the client had no alternative but to drive drunk, to save herself from sexual assault. The Nassau County Court Judge found the client “Not Guilty.”
